Deposit Terms and Conditions

1. Terms and Conditions
   1. By signing the Contract of Sale, you accept and agree to be bound by these terms and conditions.
   2. These terms and conditions apply between the Purchaser detailed in the Contract of Sale (‘You’) and Mercedes Benz Pacific/Australia Pty Ltd ACN 004 411 410 and/or its agents and related entities (MBAuP). Motor Dealer Licence details: Vic LMCT 6776, NSW MD077327, QLD MDRC 4343819, ACT Lic No. 20000323, SA MVD 298959, WA MD 28213, TAS LMCT 6071.
   3. By accepting these terms and conditions, you:
      1. agree to pay the Deposit specified to MBAuP as a holding fee for a motor vehicle that is the same or similar to the motor vehicle described in the Contract of Sale;
      2. confirm your intention to purchase a motor vehicle that is the same or similar to the motor vehicle described in the Contract of Sale, subject to entering into a legally binding contract of sale with MBAuP;
      3. understand that the information that appears on the Contract of Sale is indicative only and may be changed by you or MBAuP, subject to the terms and conditions contained in the Contract of Sale;
      4. warrant that you are over the age of 18 years and are currently located and residing in Australia; and
      5. acknowledge that MBAuP may perform its obligations under these terms and conditions via an agent or representative.
2. Deposit
   1. The Deposit is paid by you to demonstrate your genuine interest in purchasing a motor vehicle that is the same or similar to the one described in the Contract of Sale, and does not constitute payment toward any purchase price for any motor vehicle.
   2. When you sign a Contract of Sale with MBAuP and pay a Deposit, You may elect to
   (a) apply the Deposit toward the Total Purchase Price, then the Balance Due will be payable on the date of delivery of the Vehicle; or
   (b) request the Deposit be refunded, then the Total Purchase Price will be payable on the date of delivery of the Vehicle.
   3. Deposit refunds are managed in the manner outlined in the Contract of Sale relevant to your transaction.
   4. The Deposit does not attract the Goods and Services Tax (GST) as per the meaning given to that term in the A New Tax System (Goods and Services Tax) Act 1999 (Cth), on the basis that it is a holding deposit only. GST is payable in relation to the Vehicle, goods and services as detailed in the Contract of Sale.
3. Personal Information
   1. Your personal information will be handled according to the Personal Information Collection Statement which you ticked and accepted and the MBAuP Privacy Policy which can be viewed online at www.mercedes-benz.com.au.
   2. When you pay the Deposit via a credit card, your payment details will be shared with and processed through the payment gateway provided by Daimler Mobility Services GmbH trading as Mercedes pay and Adyen N.V.
   3. MBAuP does not collect your credit card information.
4. Limitation of Liability
   1. Nothing in these terms and conditions is to be read as excluding, restricting or modifying the application of any legislation which by law cannot be excluded, restricted or modified.
   2. MBAuP is not liable for failure to perform any of its obligations under these terms and conditions to the extent and for so long as its performance is prevented or delayed due to any fact, cause, thing or event beyond MBAuP’s reasonable control .
   3. Any representation, warranty, condition or undertaking which (but for this clause) would be implied into these terms and conditions by law, are excluded to the fullest extent permitted by law.
